What is the difference between Adjustment of Status and Consular Processing?

Adjustment of Status applies when the applicant is legally in the U.S. and wishes to obtain residency without leaving the country.
Consular processing applies when the applicant is outside the U.S. and completes the process at a U.S. embassy or consulate abroad.

The priority date is when the Department of Labor (DOL) receives the Labor Certification (PERM) or when USCIS receives the I-140 petition, determining the applicant's place in the queue in the Visa Bulletin.

Each month, the Visa Bulletin lists the dates in process. When your priority date is updated, a visa number will be available, allowing you to proceed with Adjustment of Status or your Consular Interview.

The EB-3 visa applies to three groups:

  • Professionals: with a bachelor's degree or its equivalent.
  • Skilled workers: with at least two years of experience or training.
  • Other workers: in unskilled positions requiring less than two years of experience.

In all cases, a permanent job offer and an approved Labor Certification (PERM) are required.
