What are the eligibility criteria for the first stage of the EB-2 NIW visa?

There are two main ways to qualify for the EB-2 NIW visa: through an Advanced Degree or through Exceptional Ability.

  1. A title, diploma, or certificate from a recognized educational institution.
  2. Letters of reference demonstrating at least 10 years of full-time professional experience.
  3. A license or certification to practice your profession.
  4. Evidence of a high salary or remuneration that reflects exceptional ability.
  5. Membership in prestigious professional associations.
  6. Recognition or awards from colleagues, government entities, or professional organizations for your contributions and achievements in the field.

In the second stage, the applicant must demonstrate that their work or project directly benefits the national interest of the United States.
USCIS evaluates three main criteria established in the decision Matter of Dhanasar (2016):

1. Substantial merit and national importance of the proposed project:
The project must have a positive impact on key areas such as the economy, education, health, technology, the environment, or social development.

2. The applicant's ability to advance the proposed project:
The applicant must demonstrate that they have the experience, qualifications, achievements, and resources necessary to successfully perform the job.

3. It would be beneficial for the United States to exempt job offers and labor certification:
It must be demonstrated that granting permanent residence without an employer or labor certification is in the national interest, since the applicant's contributions provide a significant benefit to the country.

It applies to scientific, commercial, technological, educational, or social projects that generate significant benefits for the economy, public welfare, or national competitiveness of the United States.

Premium processing only expedites the review of your I-140 petition, which USCIS must process within 15 business days. However, approval does not mean you will receive your Green Card immediately, as adjustment of status and consular processing follow their own processing times.
