By accepting this User Agreement, you are waiving your right to have your dispute resolved in a jury trial or class action lawsuit. Please read this entire agreement to understand how your rights are affected and how any disputes will be resolved.
TERMS AND CONDITIONS
SCOPE OF THE AGREEMENT
This User Agreement (“Agreement”) is entered into between you and AsisVisa (“AsisVisa”) and governs your (the “user”) access to and use of the website located at https://www.asisvisa.com, This Agreement applies to AsisVisa, including all its subdomains (the “Site”), as well as the services provided by AsisVisa (the “Services”). By accessing or using the Site or the Services, you expressly consent to and agree to be legally bound by the terms of this Agreement. If you purchase Services that include a review by an independent attorney, your relationship with that attorney will be governed by the corresponding Limited Scope Legal Representation Agreement. The Site and the Services are intended solely for individuals 18 years of age or older. If you are under 18, you are not authorized to access or use the Site or the Services.
SCOPE OF THE AGREEMENT
ACCOUNT AND INFORMATION
To access and use the features of the AsisVisa web platform, you need to create an account using a username and a password.traceinto. To the cBy creating this account, you agree to provide accurate, complete, and up-to-date personal information, and you agree to keep it updated at all times. You also represent and warrant that you will not create an account on behalf of any third party or allow others to use your account.
You are solely responsible for maintaining the confidentiality and security of your username and password. You will be responsible for all activities that occur under your account. If you detect any unauthorized use of your account, you must notify AsisVisa immediately. By creating your account, you agree to receive electronic communications from AsisVisa, including offers, news, account updates, and information about the status of your application. If at any time you wish to stop receiving these communications, you can unsubscribe by clicking the unsubscribe link included in each message.
APPLICATION
By purchasing our services, you authorize AsisVisa to link your email account to our platform in order to obtain your application receipt number directly from the relevant federal agency (USCIS). You also agree that AsisVisa may periodically review the status of your case to provide you with updates on the progress of your application. If for any reason you prefer that AsisVisa not check the status of your case or link your email account to our platform for these purposes, you may notify us through our communication channels.
ACCOUNT ACCESS RESTRICTIONS
Regarding your access to and use of our site or services, it is strictly prohibited to use informationrmuser actionAccessing our site from an unauthorized server or using a file that does not belong to you is prohibited. The use of automated engines, software, tools, or agents (such as bots, avatars, or intelligent agents), as well as any device or mechanism other than commonly accepted browsers (such as Google Chrome, Mozilla Firefox, or Microsoft Edge), to access, navigate, or search our site is also prohibited. Furthermore, the use of devices or software that interfere with the proper functioning of the platform is not permitted. Submitting false, inconsistent, or inaccurate information, as well as omitting data relevant to your application, may result in the rejection of your application by the relevant federal agency. If such a situation is a consequence of your negligence, AsisVisa will not assume any liability for any resulting damages.
USER GRANTED LICENSE
When you, as a user, transmit any informationrmaction, cBy submitting any content, material, or data through the Site or the Services—excluding those submitted for the specific purpose of creating your account or preparing applications and/or forms (hereinafter, “User Content”)—you grant AsisVisa and its affiliates a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such User Content, anywhere in the world and by any means, now known or hereafter devised.
AsisVisa assumes no obligation with respect to the User Content you provide, including but not limited to: (a) retaining such content; (b) paying you any compensation for its use; or (c) responding to or following up on submitted content. You represent and warrant that you own all necessary rights or have obtained the appropriate licenses for the User Content you submit, and that AsisVisa's use of such content does not and will not infringe upon or violate any third party's intellectual property rights, privacy rights, or other rights.
COSTS
AsisVisa provides you with relevant information for your immigration application through its website and information channels. In addition, it offers complementary services subject to a fee (“Fee”).as of SeService Fees”), the values of which are clearly stated on the website. USCIS and other government agencies also impose fees for filing and processing official forms (“Government Fees”), which are separate from our Service Fees and must be paid directly to the relevant agency at the time of filing, unless otherwise indicated. When purchasing services subject to Service Fees, you must provide AsisVisa with a valid credit card or other authorized payment method, and you authorize AsisVisa to charge the corresponding amount as the service is provided. It is your responsibility to keep your payment information up to date. If payment cannot be processed due to incorrect or expired information, or insufficient funds, AsisVisa will not be obligated to provide the services associated with those fees.
INTELLECTUAL PROPERTY
All materials present on the Site or accessible through the Services—including, but not limited to, text, images, videos, illustrations, designs, icons, photographsas, software, pPrograms and other written or visual content that does not constitute User Content (collectively, the “Protected Content”) are the property of AsisVisa or its respective licensors. This Protected Content is intended solely for your personal, non-commercial use. No right, title, or interest in or to the Protected Content is transferred to you by virtue of this Agreement or by any other means.
It is strictly prohibited to reproduce (except as expressly authorized), publish, transmit, distribute, display, modify, create derivative works from, sell, or exploit in any way, in whole or in part, the Protected Content, the Site, or any related software. "AsisVisa" and the AsisVisa logo are registered trademarks of AsisVisa.
REFERENCES TO THIRD PARTIES
References on the Site to third parties—including individuals, companies, products, or services—are provided solely as a courtesy for your convenience. AsisVisa does not expressly or implicitly endorse, recommend, or warrant such third parties or their products.soServices they offer. In particular, AsisVisa does not act as a lawyer referral service and makes no representations or warranties about the law firms or legal professionals that may be mentioned or linked from the Site, including, but not limited to, whether such lawyers or firms are properly licensed, qualified, competent, or have the capacity to provide you with appropriate legal advice for your situation. AsisVisa may also include links to third-party websites. However, it is not responsible for the content of such sites or for the truthfulness or accuracy of the information contained therein. If you choose to access a third-party website through a link provided on our Site, you do so at your own risk.
WARRANTY
The Site and Services are provided by AsisVisa “as is” and “as available”. AsisVisa makes no representations or warranties of any kind, express or implied, regarding the operation of the Site., the SeServices or the information, content, or materials available through them. To the maximum extent permitted by applicable law, AsisVisa disclaims all warranties, express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement of third-party rights. AsisVisa does not warrant that the Site or the Services are free from viruses or other harmful components, and you expressly agree that your use of the Site and the Services is at your own risk. This warranty disclaimer forms a fundamental part of this Agreement, and you acknowledge that you would not have accessed the Site or contracted the Services without accepting these limitations of liability.
This warranty waiver will not apply to the purchase of services by consumers located in the state of North Carolina, to the extent prohibited by applicable local law.
LIMITATION OF LIABILITY
Under no circumstances and under no legal or equitable theory—whether of tort (including negligence), contract, strict liability, or otherwise—will AsisVisa, its affiliates, or their respective employees, directors, officers, or agents be liable to any person for indirect, special, incidental, exemplary, or consequential damages.s of anyof any kind, arising from the use of, or inability to use, the Site or the Services. This includes, but is not limited to, losses for loss of profits, loss of business opportunities, loss of data, inaccuracy in results, or failure or malfunction of computer equipment, even if AsisVisa or any of its affiliates or representatives has been advised of, or should have foreseen, the possibility of such damages.
In any event, AsisVisa's total liability to you for any claim related to the use of the Site or the Services will not exceed the total amount you have paid for such services during the six (6) months prior to the date on which the claim arose.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for consequential or incidental damages. In such cases, the above limitations may not apply to you in whole or in part, and you may have additional rights under local law. This limitation of liability does not apply to consumers in the State of North Carolina to the extent prohibited by applicable law.
INDEMNITY
You agree to defend, indemnify, and hold harmless AsisVisa, its affiliates, and their respective directors, officers, and employees from and against any and all claims, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to:
(i) breach of this Agreement; (ii) misuse of the Site or Services; (iii) violation of any applicable law, rule or regulation; or (iv) infringement of third-party rights, including, but not limited to, intellectual property or privacy rights.
AsisVisa reserves the right to participate, at its own expense, in the defense of any claim that may give rise to such indemnification. You may not settle or negotiate any claim that implies liability or imposes an obligation—financial or otherwise—on AsisVisa without its prior written consent.
TERMINATION
You may terminate this Agreement at any time by notifying AsisVisa in writing via email to [email protected]. However, such termination will not entitle you to any refund unless the termination is due to a material breach by AsisVisa.
AsisVisa reserves the right to terminate this Agreement immediately, with or without prior notice, and/or to restrict or cancel your access to the Site or the Services, at its sole discretion, if you breach or threaten to breach any of the terms of this Agreement. If you have paid for the Services and it is determined that you have violated the terms of this Agreement, your account may be terminated without prior notice and no Service Fee will be refunded.
